Terms of Service

These Terms of Service ("Terms") govern your use of Rhythm (the "Service"), an AI-assisted sales-calling tool currently operated by an individual founder based in India ("Rhythm", "we", "us", or "our"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Rhythm helps you make and manage sales calls, including dialing, live transcription, AI-generated coaching and insights, note-taking, follow-up messages, reminders, and analytics. The Service is provided on an "as is" and "as available" basis and is under active development; features may change, and the Service may contain errors or be interrupted.

2. Eligibility and accounts

You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for the activity that occurs under your account and for keeping your access credentials secure.

3. Acceptable use and your responsibilities

You agree to use the Service only for lawful purposes. In particular, you are solely responsible for:

4. AI-generated content

The Service uses AI to generate transcripts, coaching suggestions, summaries, scores, and drafted messages. This output may be inaccurate or incomplete. You are responsible for reviewing it before relying on or acting upon it. Rhythm does not guarantee the accuracy of any AI-generated content.

5. Your data and Google account

You retain ownership of the lead and call data you put into the Service. Much of your data is stored in your own Google Sheets under your Google account. Your use of Google sign-in and Google data is also governed by our Privacy Policy. You can revoke Rhythm's access to your Google account at any time via your Google account permissions.

6. Third-party services

The Service relies on third-party providers (including Twilio, Deepgram, Google, and Render) to function. Your use of the Service may also be subject to those providers' terms. We are not responsible for the acts or omissions of third-party providers.

7. Fees

The Service may be offered free of charge, in a trial, or as a paid subscription. Where fees apply, they will be described to you before you incur them. We may change pricing with reasonable notice.

8. Disclaimers

To the fullest extent permitted by law, the Service is provided without warranties of any kind, whether express or implied, including fitness for a particular purpose, merchantability, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any AI output will be accurate.

9. Limitation of liability

To the fullest extent permitted by law, Rhythm and its founder will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or revenue, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us, if any, in the three months before the claim arose.

10. Indemnity

You agree to indemnify and hold harmless Rhythm and its founder from any claims, damages, liabilities, and expenses arising from your use of the Service, your data, or your violation of these Terms or of any law, including any claims relating to calls or messages you make through the Service.

11. Suspension and termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms, misuse the Service, or if we need to for legal or operational reasons. On termination, your right to use the Service ends; data stored in your own Google Sheets remains with you.

12. Changes to these Terms

We may update these Terms from time to time. We will revise the "Last updated" date above when we do. Continued use of the Service after changes means you accept the updated Terms.

13. Governing law

These Terms are governed by the laws of India, without regard to conflict-of-law principles. Any disputes will be subject to the courts having jurisdiction in India.
